Terms of Service & Refund Policy

Read this first. Mythic Deal is a peer-to-peer venue and payment router. We never take title to any card. The seller is the merchant of record and bears the risk of counterfeit goods, misgrading, and loss or damage in transit.

1. Agreement to these Terms

These Terms of Service and Refund Policy (the "Terms") form a binding contract between you and Mythic Deal ("Mythic Deal", "we", "us"), the operator of mythicdeal.com and its subdomains (the "Site"). By creating an account, checking the acceptance box at sign-up, listing a card, making an offer, or completing a purchase, you accept these Terms in full and confirm you have the legal capacity to do so.

If you do not agree, do not create an account and do not transact on the Site. Continued use of the Site after a posted revision constitutes acceptance of the revised Terms. We record the version you accepted and the timestamp of that acceptance on your account.

You must be at least 18 years old, or the age of majority in your jurisdiction, to buy or sell. Accounts belonging to minors will be closed and open funds returned to the originating payment method.

2. Our role: venue and payment router only

Mythic Deal is a peer-to-peer venue. We provide listing tools, catalog data, search, negotiation tooling, cart optimization, and a payment routing layer operated through our third-party payment processor. We are not a party to any sale.

  • We never take title to, possess, inspect, authenticate, grade, store, pack, or ship any card.
  • The seller is the merchant of record for every order and is solely responsible for the item, its description, its authenticity, its condition, and its delivery.
  • Funds moving through the Site are collected on the seller's behalf and remitted to the seller net of fees. Mythic Deal is not a bank, escrow agent, insurer, shipping carrier, or fiduciary.
  • Nothing on the Site is an appraisal, investment advice, or a guarantee of resale value. Price graphs, market baselines, and AI-generated card write-ups are informational estimates and may be inaccurate or incomplete.

3. Accounts, identity, and security

You must provide accurate registration information and keep it current. You are responsible for all activity on your account and for keeping your credentials secure. Notify us immediately of any unauthorized access.

Sellers who take payouts must complete identity and bank verification with our payment processor. We may suspend listing, payout, or purchasing privileges pending verification, and we may refuse, limit, or terminate any account at our discretion, including where we reasonably suspect fraud, counterfeiting, chargeback abuse, or circumvention of these Terms.

One person, one account, unless we approve otherwise in writing. Creating a replacement account after suspension is a material breach and forfeits any pending payout to the extent permitted by law.

4. Seller obligations and listing accuracy

By listing a card you represent and warrant, for each unit listed, that:

  • You own the card outright, it is in your physical possession at the time of listing, and it is free of liens or third-party claims.
  • The card is a genuine, factory-produced product of Wizards of the Coast. It is not a proxy, counterfeit, forgery, altered card, rebacked or repaired card, tournament-stamped card presented as unstamped, or a print-and-play reproduction.
  • The condition, finish (foil/non-foil), language, printing/set, and quantity in the listing are accurate and match the exact physical card you will ship.
  • Any damage, alteration, signature, stamp, wear, whitening, bend, crease, water damage, or other flaw is disclosed in the listing description, and photographs, where provided, are of the actual card.
  • Your listing complies with all applicable laws, including sales tax and income reporting obligations, which are your responsibility.

Condition grading follows industry-standard definitions (Near Mint, Lightly Played, Moderately Played, Heavily Played, Damaged). Systematically overgrading is treated as a misdescription and, where repeated, as fraud.

Sellers must ship within three (3) business days of order confirmation unless the listing states a longer handling time, and must enter valid carrier and tracking information on the Site at the time of shipment.

5. Zero-tolerance counterfeit and proxy policy

Listing, shipping, or attempting to sell a counterfeit, proxy, or otherwise non-genuine card is strictly prohibited and is the most serious violation of these Terms.

If a card is determined to be non-genuine, the following applies, without exception:

  • The buyer receives a full refund of the item price and all shipping paid, funded entirely by the seller.
  • The seller forfeits all fees, receives no payout on that order, and bears the cost of return shipping (or, where a carrier or law prohibits returning counterfeit goods, the cost of documented destruction).
  • Mythic Deal may withhold, reverse, or claw back the seller's pending and future payouts up to the full amount of the buyer's loss, our fees, chargeback costs, and reasonable administrative costs.
  • The seller's account is permanently banned, all remaining listings are removed, and the seller indemnifies Mythic Deal for any resulting claim, chargeback, penalty, or legal cost.
  • We may report the seller and the transaction to the payment processor, the rights holder, and law enforcement, and may retain and disclose transaction records for that purpose.

Determination process: a buyer must open a counterfeit report within seven (7) days of delivery and submit clear photographs (front, back, edge, and a light or rosette test where possible). We will review the evidence and may require an opinion from a recognized third-party authenticator. Where the evidence is inconclusive, the sale is unwound: the buyer returns the card with tracking and is refunded on delivery of the return, with return shipping paid by the seller.

Buyers may not knowingly purchase proxies, and may not swap a genuine card for a counterfeit and return the counterfeit. Return-swap fraud results in a permanent ban, denial of refund, and referral to the payment processor and law enforcement.

6. Shipping, lost mail, and who absorbs the loss

Risk of loss stays with the seller until the card is confirmed delivered to the buyer's address. This is the controlling rule of this Agreement and it overrides any contrary carrier term, listing note, or private message.

  • If a package is lost, stolen, destroyed, or never scanned as delivered, the seller absorbs the loss and the buyer is refunded in full, including shipping.
  • Mythic Deal does not absorb lost-mail losses and is not an insurer of any shipment. Our liability for a lost or damaged shipment is zero.
  • Sellers must use a trackable service. Orders with a total item value of USD $50 or more must ship with tracking and signature or equivalent proof of delivery; orders of USD $250 or more must additionally carry carrier insurance for the full order value. A seller who ships below these thresholds waives any argument that the loss should fall elsewhere.
  • Filing and pursuing the carrier claim (USPS, UPS, FedEx, or other) is the seller's responsibility and the seller keeps any claim proceeds. The buyer's refund is not contingent on the outcome or timing of that claim.
  • Cards damaged in transit are treated as the seller's risk on the same basis. The buyer must report transit damage with photographs of the packaging and card within seven (7) days of delivery.

Non-delivery window: if tracking shows no delivery scan within fifteen (15) calendar days of the last movement scan for domestic shipments, or thirty (30) calendar days for international shipments, the order is deemed lost and the buyer is refunded in full from the seller's proceeds.

Delivered-but-missing packages: where tracking shows delivery to the address the buyer supplied and the buyer reports the package as stolen or misdelivered, the buyer must file a carrier or local police report. In this narrow case only, the seller may retain payment if the seller shipped with signature confirmation or equivalent proof of delivery and complied with the thresholds above. Absent that proof, the seller absorbs the loss.

Address accuracy is the buyer's responsibility. Orders shipped to an incorrect address supplied by the buyer are not refundable, though the seller may re-ship at the buyer's cost if the package is returned to sender.

International shipments: the buyer is the importer of record and pays all duties, taxes, and customs fees. Seizure by customs of a genuine, accurately described card is not refundable by Mythic Deal; the seller and buyer must resolve it directly, with the seller's obligation limited to cooperating in the carrier claim.

7. Refund policy

All sales are final except in the circumstances listed below. Buyer's remorse, a later price drop, a metagame or format change, a ban announcement, a reprint, or a subsequent lower listing by another seller are not grounds for a refund.

A buyer is entitled to a full refund of the item price and shipping when:

  • The card is counterfeit, proxied, altered, or otherwise not genuine.
  • The card was never delivered within the non-delivery window described above.
  • The card arrived damaged in transit, with photographic evidence submitted within seven (7) days of delivery.
  • The card materially differs from the listing: wrong card, wrong set or printing, wrong language, wrong finish, wrong quantity, or a condition grade at least two full steps below what was listed.
  • The seller fails to ship within seven (7) calendar days of order confirmation, or cancels after payment.

Partial refunds may be agreed between buyer and seller for a one-step condition discrepancy or an undisclosed minor flaw, in place of a return.

Return mechanics: unless the item is counterfeit or non-delivered, the buyer must return the card in the same condition and in protective packaging (sleeve, toploader or equivalent, rigid mailer) with tracking within five (5) business days of an approved return. Refunds are issued once return delivery is confirmed. Return shipping is paid by the seller where the seller is at fault, and by the buyer where the return is a courtesy accepted by the seller.

Refunds are returned to the original payment method. Processing fees on refunded orders are not recoverable from Mythic Deal and are borne by the seller.

Claims not raised within seven (7) days of delivery, or thirty (30) days of the order date where no delivery occurs, are waived.

8. Dispute resolution and chargebacks

Buyers and sellers must first attempt to resolve an issue through the Site's order messaging and issue-reporting tools. If unresolved after three (3) business days, either party may escalate to Mythic Deal support.

We will review the record — listing text, photographs, messages, tracking, and authenticator opinions — and issue a decision. Our decision governs the release, withholding, reversal, or refund of funds routed through the Site. It is a commercial decision about payment routing, not a legal adjudication of the parties' rights against one another.

Initiating a chargeback or payment-processor dispute before completing this process is a breach of these Terms. Where a chargeback is filed and we determine the buyer was not entitled to a refund, we may suspend the buyer's account and recover the chargeback amount and fees. Where the seller is at fault, chargeback amounts and fees are deducted from the seller's payouts.

Payout holds: we may hold seller proceeds for up to fourteen (14) days after confirmed delivery, and longer while a dispute, counterfeit report, or fraud review is open. Auto-release occurs where a shipped order is delivered and no issue is reported within the applicable window.

9. Fees, taxes, and payouts

Marketplace and payment-processing fees are disclosed in the seller flow before a listing goes live and at checkout for buyers. Fees are deducted from seller proceeds. Shipping charges are set by the seller and collected on the seller's behalf.

Sellers are solely responsible for reporting and remitting all income, sales, use, and other taxes arising from their sales. Where required, our payment processor will issue tax forms based on the information the seller supplies.

Payouts are made to the seller's verified account by our payment processor on its schedule. We may offset any amount a seller owes — refunds, chargebacks, counterfeit losses, lost-mail losses, or fees — against current and future payouts.

10. Prohibited conduct

  • Listing counterfeits, proxies, altered cards presented as unaltered, or cards you do not possess.
  • Shill bidding, fake offers, price manipulation, or coordinating listings to distort market data.
  • Taking transactions off-platform to avoid fees, or soliciting off-platform payment.
  • Scraping, automated bulk querying, or reselling Site data other than through provided tools.
  • Abusive, harassing, discriminatory, or threatening conduct toward another user or our staff.
  • Uploading malware, attempting to breach the Site's security, or bypassing access controls including administrative areas.

We may remove listings, cancel orders, reverse routed funds, and suspend or terminate accounts for any violation, with or without notice.

11. Intellectual property

Magic: The Gathering, card names, card images, mana symbols, set symbols, and related marks are the property of Wizards of the Coast LLC. Mythic Deal is not produced by, endorsed by, supported by, or affiliated with Wizards of the Coast. Card data and images are used for identification and reference under Wizards' fan content policy and via the Scryfall API.

User-submitted photographs, descriptions, and reviews remain yours; you grant Mythic Deal a worldwide, non-exclusive, royalty-free license to host, display, and reproduce them in connection with operating and promoting the Site.

AI-generated card write-ups are derived from published rules text and are provided for informational purposes without warranty of accuracy.

12. Disclaimer of warranties

The Site is provided "as is" and "as available". To the maximum extent permitted by law, Mythic Deal disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.

We do not warrant that listings are accurate, that cards are genuine, that sellers will perform, that pricing data is correct, or that the Site will be uninterrupted or error-free. Any warranty regarding a card runs from the seller to the buyer, not from Mythic Deal.

13. Limitation of liability and indemnity

To the maximum extent permitted by law, Mythic Deal and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost collection value, or loss of data, arising out of or relating to the Site or any transaction, even if advised of the possibility.

Our total aggregate liability to you for all claims arising in any twelve (12) month period is limited to the greater of (a) the total marketplace fees we actually collected from you in that period, and (b) USD $100.

We are specifically not liable for: counterfeit cards sold by a seller; packages lost, stolen, delayed, seized, or damaged by any carrier; a seller's failure to ship; a buyer's failure to pay or return; inaccurate pricing, catalog, or AI-generated content; or the acts of our payment processor or any other third party.

You agree to indemnify, defend, and hold Mythic Deal harmless from any claim, demand, loss, liability, penalty, or expense (including reasonable attorneys' fees) arising from your listings, your shipments, your purchases, your content, your taxes, your breach of these Terms, or your violation of any law or third-party right.

14. Privacy and data

We collect account, transaction, shipping, and device data to operate the Site, route payments, prevent fraud, and comply with law. Shipping details are shared with your counterparty for the purpose of fulfilling the order and must not be used for any other purpose.

Payment card data is handled by our payment processor and is never stored on our servers. We retain transaction and dispute records for as long as required for legal, tax, and fraud-prevention purposes.

15. Governing law, arbitration, and class-action waiver

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules.

Any dispute between you and Mythic Deal that is not resolved informally within thirty (30) days of written notice will be resolved by final and binding individual arbitration administered by a recognized arbitration provider, seated in California, in English. You and Mythic Deal each waive the right to a jury trial and to participate in a class, collective, or representative action. Either party may bring an individual claim in small-claims court instead.

Disputes strictly between a buyer and a seller are between those parties. Mythic Deal is not a necessary party and our determinations about payment routing do not create liability on our part.

16. Changes, termination, and contact

We may modify these Terms at any time by posting an updated version with a new version number and effective date. Material changes will be surfaced in-app and may require renewed acceptance before you continue transacting. Sections that by their nature should survive termination — including counterfeits, shipping risk, refunds, fees owed, liability, indemnity, and arbitration — survive.

You may close your account at any time; obligations for open orders, refunds, and amounts owed survive closure.
